SECCIÓN 5 - ENVÍO Y ENTREGA
No somos responsables de retrasos en el envío y la entrega. Todos los tiempos de entrega son estimados y no están garantizados. Además, aceptas no: (a) subir o transmitir virus u otro tipo de código malicioso que pueda emplearse de cualquier manera para afectar la funcionalidad u operación de los Servicios; (b) reproducir, duplicar, copiar, extraer, vender, revender o explotar cualquier parte de los Servicios; (c) recopilar o rastrear información personal de otros; (d) hacer spam, phishing, pharming o pretextar los Servicios; (e) usar robots, arañas, herramientas de extracción y recopilación de datos, dispositivos o procesos automáticos, herramientas de IA (como IA agente) o medios automáticos o manuales para acceder a los Servicios; o (f) interferir, eludir o burlar las funciones de seguridad o autorización, los encabezados de exclusión de robots u otras medidas que empleamos para restringir el acceso a los Servicios. Nos reservamos el derecho de suspender, deshabilitar o cancelar tu cuenta en cualquier momento y sin previo aviso, si determinamos que has violado alguna parte de estos Términos.

SECCIÓN 14 - AGENTES

14.3 Podemos limitar, mediante medidas técnicas, si un Agente accede, usa o interactúa con los Servicios y de qué manera lo hace.

14.4 Los Agentes deben: (i) en todas las solicitudes HTTP/HTTPS, identificar que la solicitud proviene de un Agente y revelar el nombre del Agente, incluyendo en la cadena «user agent» de la solicitud lo siguiente: «Agent/[nombre del agente]»; (ii) no ocultar ni ofuscar que el acceso, uso o interacciones provienen de un Agente, por ejemplo (a) imitando patrones de comportamiento e interacción humanos, o (b) completando o eludiendo CAPTCHA u otras medidas destinadas a distinguir el uso por computadoras del uso por humanos; (iii) responder con veracidad a cualquier pregunta o mensaje que busque determinar si las interacciones provienen de un humano o de una computadora; y (iv) no eludir ni evitar ninguna medida destinada a bloquear, limitar, modificar o controlar si los Agentes acceden, usan o interactúan con los Servicios y cómo lo hacen.

Podemos rescindir este acuerdo o tu acceso a los Servicios (o cualquier parte de ellos) a nuestra sola discreción en cualquier momento y sin previo aviso, y seguirás siendo responsable de todos los montos adeudados hasta la fecha de terminación inclusive.

SALVO LO EXPRESAMENTE INDICADO POR Sacramentals, LLC, LOS SERVICIOS Y TODOS LOS PRODUCTOS OFRECIDOS A TRAVÉS DE LOS SERVICIOS SE PROPORCIONAN «TAL CUAL» Y «SEGÚN DISPONIBILIDAD» PARA TU USO, SIN DECLARACIONES, GARANTÍAS NI CONDICIONES DE NINGÚN TIPO, YA SEAN EXPRESAS O IMPLÍCITAS, INCLUYENDO TODAS LAS GARANTÍAS O CONDICIONES IMPLÍCITAS DE COMERCIABILIDAD, CALIDAD COMERCIABLE, APTITUD PARA UN PROPÓSITO PARTICULAR, DURABILIDAD, TITULARIDAD Y NO INFRACCIÓN. NO GARANTIZAMOS, DECLARAMOS NI ASEGURAMOS QUE TU USO DE LOS SERVICIOS SERÁ ININTERRUMPIDO, OPORTUNO, SEGURO NI LIBRE DE ERRORES. ALGUNAS JURISDICCIONES LIMITAN O NO PERMITEN LA EXENCIÓN DE GARANTÍAS IMPLÍCITAS U OTRO TIPO DE GARANTÍAS, POR LO QUE LA EXENCIÓN ANTERIOR PODRÍA NO APLICARSE EN TU CASO.

SECCIÓN 17 - LIMITACIÓN DE RESPONSABILIDAD
EN LA MEDIDA MÁXIMA PERMITIDA POR LA LEY, EN NINGÚN CASO Sacramentals, LLC, NUESTROS SOCIOS, DIRECTORES, FUNCIONARIOS, EMPLEADOS, AFILIADOS, AGENTES, CONTRATISTAS, PROVEEDORES DE SERVICIOS O LICENCIATARIOS, NI LOS DE SHOPIFY NI SUS AFILIADAS, SERÁN RESPONSABLES POR NINGUNA LESIÓN, PÉRDIDA, RECLAMACIÓN NI NINGÚN DAÑO DIRECTO, INDIRECTO, INCIDENTAL, PUNITIVO, ESPECIAL O CONSECUENTE DE NINGÚN TIPO, INCLUIDO, SIN LIMITARSE A ELLO, LA PÉRDIDA DE BENEFICIOS, INGRESOS, AHORROS, DATOS, COSTOS DE REEMPLAZO O CUALQUIER OTRO DAÑO SIMILAR, YA SEA BASADO EN CONTRATO, AGRAVIO (INCLUIDA NEGLIGENCIA), RESPONSABILIDAD ESTRICTA U OTRO, DERIVADO DE TU USO DE LOS SERVICIOS O DE CUALQUIER PRODUCTO ADQUIRIDO MEDIANTE LOS SERVICIOS, O POR CUALQUIER OTRO RECLAMO RELACIONADO EN CUALQUIER FORMA CON TU USO DE LOS SERVICIOS O DE CUALQUIER PRODUCTO, INCLUYENDO, ENTRE OTROS, CUALQUIER ERROR U OMISIÓN EN CUALQUIER CONTENIDO O CUALQUIER PÉRDIDA O DAÑO DE CUALQUIER TIPO INCURRIDO COMO RESULTADO DEL USO DE LOS SERVICIOS O DE CUALQUIER CONTENIDO (O PRODUCTO) PUBLICADO, TRANSMITIDO O PUESTO A DISPOSICIÓN A TRAVÉS DE LOS SERVICIOS, INCLUSO SI SE HA ADVERTIDO SOBRE LA POSIBILIDAD DE TALES DAÑOS.

SECCIÓN 18 - INDEMNIZACIÓN
Aceptas indemnizar, defender y mantener indemnes a Sacramentals, LLC, Shopify y nuestras afiliadas, socios, directores, funcionarios, empleados, agentes, contratistas, licenciatarios y proveedores de servicios de cualquier pérdida, daño, responsabilidad o reclamación, incluyendo honorarios razonables de abogados, pagaderos a cualquier tercero debido a, o derivados de: (1) tu incumplimiento de estos Términos de servicio o de los documentos que se incorporan por referencia; (2) tu violación de cualquier ley o de los derechos de terceros; o (3) tu acceso y uso de los Servicios.

Te notificaremos cualquier reclamación sujeta a indemnización, siempre que nuestra falta de notificación oportuna no te libere de tus obligaciones salvo que te cause un perjuicio material. Podremos controlar la defensa y resolución de dicha reclamación a tu cargo, incluyendo la elección de abogados, pero no resolveremos ninguna reclamación que exija obligaciones no monetarias de tu parte sin tu consentimiento (que no deberá retrasarse injustificadamente). Cooperarás en la defensa de las reclamaciones indemnizadas, incluyendo la entrega de documentos relevantes.

SECCIÓN 19 - DIVISIBILIDAD
